Who you are contracting with

PPS Insight™ is provided by Proven Profit Solutions Ltd ("we", "us"). By creating an account or continuing to use the service you agree to these terms. If you are using the service for a business, you confirm you have authority to accept these terms on its behalf; if you are using it personally, you confirm you are of legal age.

The service

PPS Insight helps business leaders turn what they know about their business into clear executive decisions. You receive a limited, non-exclusive, non-transferable right to use the service within the plan you have selected.

Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your sign-in credentials confidential and for activity carried out under your account.

Acceptable use

You must not use the service:

• for any unlawful purpose, or for fraud, spam or misrepresentation;
• to infringe anyone's intellectual property or confidentiality;
• to interfere with the security or integrity of the service — including malware, probing, penetration attempts, automated scraping or circumventing technical limits;
• to reverse engineer, resell or redistribute the service or its outputs as a product.

Your content

You keep ownership of the business information you provide. You grant us a limited licence to host and process it solely to provide the service to you. You confirm you have the right to share the information you submit.

Our intellectual property

We retain ownership of the service and all intellectual property in it, including the software, methodology, documentation and branding. Nothing in these terms transfers that ownership to you.

Service level

We work to keep the service available and accurate, but we do not guarantee that it will be uninterrupted or error-free. Outputs are decision support: they do not replace your own judgement, and they are not financial, legal, tax or investment advice.

Payment and subscriptions

Access is offered on a monthly subscription. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, renewal, cancellation and refund mechanics are governed by Paddle's Buyer Terms, together with our refund policy. Where a payment is made by mobile money, access is activated once the payment is confirmed by us.

Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. On termination you may request an export of your business record within 30 days, after which it may be deleted.

Warranties and liability

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special losses, including loss of profits, data or goodwill. Our total liability is limited to the fees you paid in the twelve months before the claim. Nothing here limits liability for fraud, death or personal injury where the law does not allow it.

Indemnity

You will indemnify us against claims arising from the information you submit, from unlawful use of the service, or from your breach of these terms.

General

These terms are governed by the laws of the Republic of Zambia, and its courts have jurisdiction. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
